UNA CRÍTICA A LA CLÁUSULA DE NACIONALIDAD: EL MAYOR OBSTÁCULO PARA LA VERDADERA LIBERALIZACIÓN DEL TRANSPORTE AÉREO

Durante las últimas décadas del siglo xx, los Estados comenzaron a liberalizar el transporte aéreo, suprimiendo muchas de las regulaciones existentes en materia de fijación de precios, rutas y capacidad (Doganis, 2006). Sin embargo, dicha liberalización distó de ser total. Posiblemente, el mayor obstáculo pendiente para la liberalización completa del sector sea la famosa Cláusula de Nacionalidad o Regla de Nacionalidad, es decir, el imperativo legal por el cual los Estados prohíben la propiedad extranjera de las aerolíneas asentadas en ellos, vigente en la mayoría de países (Walulik, 2016; Foro Económico Mundial, 2016).
